Cases Which May Be Appealed

An appeal may be made ​​to the Board of Appeals based on the things that have been provided in the Town and Country Planning Act, 1976 (Act 172), Town and Country Planning Act 1995 (Amendment) Act A933, namely:
Appeal Against Refusal of Planning Permission or Planning Permission and Rejection Objection Provided by Local Authorities, section 23 (1) (a) and (b).
  • Planning Permission An applicant aggrieved by the decision of the Local Planning Authority refused to grant planning permission or with the conditions imposed by the Local Planning Authority in giving planning permission.

    and

  • A person who has lodged an objection pursuant to section 21 (6) and is aggrieved by the decision of the Local Planning Authority in relation to the objection.


Appeal Against Amount of Compensation, Section 25 (9).

  • If a person is aggrieved by the amount of any reimbursement or compensation offered or paid to him, he may appeal to the Appeal Board to assess the amount of reimbursement to be paid.

Appeals on Demand Notice, Section 30 (2).

  • A person or a landlord who is aggrieved by the request of the Local Planning Authority with the approval of the State, namely:
    • Requesting be terminated, or
    • Impose any conditions for use of the land as may be specified in the notice of demand, or
    • Request that the measures set out in the notice to be taken to alter or amend the building or work.

Appeal against Compensation Amount Due To Demand Notice, section 30 (7).

  • Someone offered compensation under sub-section (6) which is aggrieved by the amount of such compensation, it shall, within the time and in the prescribed manner, appeal to the Appeal Board shall assess the amount of compensation to be paid.


Appeal Against Tree Preservation Order under Section 35C

  • Any person aggrieved by a tree preservation order, any conditions imposed and an order to plant or replace trees.


Appeal Against Compensation Under Tree Preservation Order under Section 35D.

  • Landowner whose land is meant by an order of the gazetted Tree Conservation, prove it suffered a loss of the value of the land, due to meet paragraph (a) to (d) of section 35C


Appeals against Tree Replacement, section 35E (3).
